Persecution based on Political Opinion Using Protection Orders

A Protection Order means any Order that prohibits the Restrained Person from contacting, harassing, injuring, intimidating, molesting, threatening, or touching any Protected Person, or from threatening, taking, transferring, concealing, harming, or disposing of an animal owned, possessed, leased, kept, or held by a Protected Person, or from entering or remaining on premises, or from coming within a specified distance of a Protected Person or premises, or any other provision to protected the Protected Person from imminent danger to life or health.

(a.5) A second or subsequent violation of a protection order is an extraordinary risk crime that is subject to the modified sentencing range specified in section 18-1.3-501(3).

This section contains reports which will illustrate the states continued campaign of repression and persecution against myself and others based on our political opinion. Under penalty of arrest and imprisonment I am prevented from availing myself of the protection of the State of Colorado. As members of the government of Colorado, in their official capacity, have taken out multiple protection orders against me. These protection orders verified, and alluded to, clearly show the state’s persecution of me based on my political belief. All but one of the protection orders specifically prevent me from entering the State Capitol and exercising my human right to voice my political opinion and to peacefully assemble.

The state even went so far as to arrest me in the in the State Capitol specifically because I was exercising my human rights. The history recorded below is yet another aspect of the Governments of the United States of America´s policy of threatening the life and liberty of myself and others based on our political beliefs. The reports below will detail another reason as to why I am unwilling and unable to avail myself of the protection of the governments of the United States of America.

False Arrest and Repression of Political Opinion by the State Part 1

On November 8th 20211, one week after being denied access to the City and County building and before even entering the state capitol. myself and others from were denied access by Officer C.J. Valdez. We were denied access based on Officer Valdez´s personal interpretation of Coloradan’s constitutional right to access cannabis, in the form of medical marijuana. I was threatened with being denied access because I was citing the constitution of Colorado to everyone assembled. State patrol C.J. Valdez warns me that if I continue with my political speech I will be asked to leave the building. Aside from myself officer C.J. Valdez also illegally denies a person access to the capitol because that person had medical marijuana; even though the person’s medical marijuana was possessed in compliance with the state constitution and state rules and regulations.

"The brief march across the street ended with an early setback for the group when one of its members was refused entry to the building because of the medical marijuana on his person, though he offered his medical card as proof of its legitimacy. Donahue, an outspoken marijuana activist, took offense to the action and challenged its constitutional legitimacy in front of state patrol officers running security for the building. Officer C.J. Valdez responded by warning Donahue and the rest of the group to calm down or be forced to leave the premises."

Finally in the State Capitol and during a peaceful political discussion regarding the states repression and denial our human rights, the state again repressed and denied our human rights. The state did this by prohibiting a peaceful political discussion, which was taking place in and around the public waiting room of the Governor's office in the State Capitol. During this I was arrested on false charges in the public waiting room of the governor’s office. By threatening the people with arrest for trespassing and falsely arresting me in the state capitol a public building, the state once again has violated the human rights of a peaceful people.

"Although that plan might still be in place, its first day ended early when security put a collective foot down against the protesters' continued presence in the office around 3 p.m. The group, which had rotated a few members in and out by that point, was escorted out by the state patrol during Donahue's arrest. "We stalled as long as we could in his office, but they made us leave," Duffy says. "I went outside on the phone with Corey's lawyer, and when I turned around, the rest of them had been kicked out."

The following day the state, personified by Officer C.J. Valdez, inform me I am banned from entering the capitol specifically because of my political speech. This was the same C.J. Valdez that attempted to prohibit the assembly access the state capitol the previous day. My political speech, which the state refers to as verbal assaulting and which no criminal charges were ever pressed, was me informing people that that the State Patrol does not respect human rights and again, as I did the previous day, pointed to a notification sign posted in the capitol attempting to justify the State violation people’s human rights. These are the same reason the state attempted to prevent me from entering the capitol the previous day.

“Donahue, who was accused of verbally assaulting a state patrol officer this morning, is currently prohibited from entering, though officials aren't sure how long this ban will last, officer C.J. Valdez says. Donahue says he'll return tomorrow to see if the ban is still in place, though a final attempt today ended with him being promptly escorted from the building and the door shut behind him.” “When asked how state troopers are enforcing Donahue's ban from the building, Valdez said that a supervisor made the decision and that there's no need to pass around Donahue's image. “We’re all aware who he is," Valdez says. "We've had experience with him before."

The following days I was prevented from entering the capitol, protection orders were never presented or even taken out against me and the officers of the state lied about said protection orders. I was continually told that my ban was still in force by orders of a superior officer. Banning me from the capitol was done solely based on the personal opinion of a superior officer of the state, who was never identified, using his position to enforce his will against my political opinion with no legal backing. All documents can and should be provided by the city and county of Denver and the state of Colorado.

This is a clear example of state persecution against me from simply exercising my human right to voice my political opinion. AS such I am unwilling and unable to avail myself of the protection of the governments of the United States of America.

Repression of Political Opinion by the Colorado State Patrol, Part 2

Another round of protection orders, allegedly, taken out against me by two members of the Colorado State Patrol. These orders again prevent me from entering the Capitol. The new reason why I cannot enter the capitol came along not coincidentally the instant I again attempted to enter the Capitol, after it was closed for the holidays. The state came up with this new excuse because I continually questioned the legality of prohibiting me from the capitol. This time the orders are no longer came from a superior office. Yet once again no protection order could be furnished when requested from the state. Again no protection orders were ever taken out against me and I was only reason I was prevented from entering the Capitol was due to the states continued effort to persecute me based on my political opinion. A commanding officer of the Colorado State Patrol, states that it is a personal matter which the officers are using their position in government to persecute me based on their personal opinion of my political speech.

"They have restraining orders against Corey Donahue, but they are victims just like anyone else," says CSP Sergeant Mike Baker. "They just happen to be state troopers. To an extent, it's a personal matter. It's just these two gentleman."

No protection orders were ever taken out against me or provided to me. However the state used a fabricated charge based on my political speech which I incurred in Civic Center Park, to justify my banning from the capitol. Again no protection orders were provided when requested. All documentation can and should be provided by the state of Colorado.

Sgt. Speelman’s Protection Order as Continued Repression

Once again, a member of the Government acting in their official capacity to persecute me based on my political belief. An actual protection order obtained by Sgt. Perry Spealman of the Denver Police Department and includes his name, rank and badge number 92045 making this protection order an official order taken out by a member of the state acting in his official capacity against me for voicing my political opinion. This protection order applied for and granted by the City and County of Denver in the State of Colorado protects Sgt. Perry Spealman, in his official capacity, from me. The protection order also restricts me from entering the Capitol and both Civic Center and Lincoln Park, which are the sites for every major public political action taken in the state, including this peaceful political assembly and monthly cannabis rally at which I frequently voiced my political opinion.

This order is dated April 30, 2012. The alleged incident, which Sgt. Speelman lied about in order to obtain this protection order, did not take place in or around the capitol complex and Sgt.Perry Speelman is not a member of the Colorado State Patrol which is the law enforcement arm of the State Capitol. As such there is no connection between Sgt. Speelman and the capitol, the only reason for this protection order and the area restriction preventing me from entering the capitol is to silence and persecute me based on my political opinion. Due to this protection order, in which a member of government lied in order to obtain, and was taken out by a member of government acting in his official capacity, I was prevented from exercising my Human Right to take part in my government regarding political matters of which I am on record as being a deeply concerned.

This also represents the first protection order ever presented to me by the state. Although during the above incidents I frequently requested a copy of the protection orders taken out against me. As the state granted Sgt. Speelman a restraining order for robbing and assaulting me. I too attempted to get a protection order. As I had my cell phone stolen by Sgt. Speelman and when I attempted to recover it I was peppersprayed, and violently assaulted by the Denver Police Department. The court said my protection order was denied specifically because Sgt. Speelman was a member of Colorado law enforcement and I cannot get a protection order against them.

The date and area restriction of this protection order specifically persecuted me based on my political beliefs, by preventing me from voicing my political opinion to my government during a historical special session of legislature. This special session was done at the will of the governor and was called specifically to pass cannabis driving under the influence bill, which failed in the regular session and of which I am a vocal opponent.

A year prior to this protection order, a similar cannabis DUI bill which was eventually defeated and my political opinion and work was credited with defeating this cannabis DUI bill. A very similar cannabis DUI bill was introduced during the 2012 legislative session and again I and others worked diligently to oppose this bill. It was defeated in the regular session; however the Governor, who is on record as being anti-cannabis, called a special session of legislature in order to again thwart the will of the people and attempt to violate peoples human rights by passing a bill allowing for forced blood draws and criminalization of non-criminal conduct.

I am an opponent of these cannabis DUI bills because they are a violation of Article 3 of the UN Delectation of Human Right where it says, “Everyone has the right to life, liberty and security of person.” These proposed pieces of legislation all allow for the government to forcefully use syringes to enter my body and remove my blood in order to garner evidence against for a minor crime created by the state, in oreder to persucute people. If the state can attempt to pass bills that violate my human right to liberty and security of person and at the same time prevent me, under penalty of arrest and imprisonment, from voicing my political opinion against this and similar threats to me, then in what sense do I have liberty or security of person? All additional documentation of my claims can and should be provided by the city and county of Denver.

This Cannabis DUI bill which was passed during the 2013 legislative session. The state can now forcefully test your blood for an manufactured criminal offense. Hb 13-1325 specifically criminalizes me for exercising my constitutional right to access medical marijuana.

(j) IN ANY TRIAL FOR A VIOLATION OF THIS SECTION, IF, AT THE TIME OF THE ALLEGED OFFENSE, THE PERSON POSSESSED A VALID MEDICAL MARIJUANA REGISTRY IDENTIFICATION CARD, AS DEFINED IN SECTION 25-1.5-106 (2) (e), C.R.S., ISSUED TO HIMSELF OR HERSELF, THE PROSECUTION SHALL NOT USE SUCH FACT AS PART OF THE PROSECUTION'S CASE IN CHIEF.

(k) IN ANY TRAFFIC STOP, THE DRIVER'S POSSESSION OF A VALID MEDICAL MARIJUANA REGISTRY IDENTIFICATION CARD, AS DEFINED IN SECTION 25-1.5-106(2)(e), C.R.S., ISSUED TO HIMSELF OR HERSELF SHALL NOT, IN THE ABSENCE OF OTHER CONTRIBUTING FACTORS, CONSTITUTE PROBABLE CAUSE FOR A PEACE OFFICER TO REQUIRE THE DRIVER TO SUBMIT TO AN ANALYSIS OF HIS OR HER BLOOD.

Due to my fear of lose of life and liberty I am unwilling and unable to avail my self of the protection of the governments of the United States of America.

Other Municipalities Organized Repression Using Protection Order Against Political Opinion

Unfortunately the above incidents where not the only time the state persecuted people based on their political opinion, using the same methods during the same time frame. The below report details the City and County of Boulder twice using restraining order to prevent people from exercising their political opinion. The first protection order was used against Mr. Jentsch. Someone like me who participated in the peaceful assemblies in both Boulder and Denver and has also faced a protection orders aimed at repressing his political opinion.

"I think that (the restraining order) is very specifically chilling to my First Amendment freedom of speech, but it was suggested by the prosecutor and approved by the judge in court yesterday," Jentsch says. "It feels directly aimed at keeping me from exercising my right to protest."

The second attempt by the state to repress political opinion using protection orders happened to Seth Brigham who frequently exercised his political opinion only to be arrested in the Boulder City and County Building.

"At that point, Mayor Susan Osborne cut Brigham off: "She told me I couldn't talk about council members in a personal way," Brigham remembers. "I basically protested that, saying, 'I can speak about what I want to speak about. This is my three minutes.' And then a police officer came up to me and handcuffed me and escorted me out."

The arrest of Seth for exercising his rights is even more insidious when looking at the allegations presented by the City of Boulder justifying his arrest. The City of Boulder arrested Seth for trespassing in a public building during public testimony in which he was exercising his political opinion. This is not the first time the City of Boulder has arrested people for trespassing for exercising their political opinion in a public area.

“He has no idea how he could be guilty of trespassing, since the city council meeting was open to the public… Because I didn't do anything wrong. I have constitutional rights. And my constitutional rights were violated."

The next report showcases the continued campaign by the state against Mr. Seth Brigham based on Mr. Brigham’s political opinion. The state first attempted to arrest and criminalizes both myself and Mr. Brigham, when that failed and we both continued to exercise our political opinion, the state then turned to protection orders in order to prevent us from exercising our political opinion. The restraining order taken out against Seth, seeks to prohibit Mr. Brigham from coming within fifty yards of the Boulder Municipal Building, at 1777 Broadway, and forbidding him to contact all nine members of the city council, plus the city manager, the city clerk and Patrick von Keyserling, the city's communications manager.

The state uses protection orders specifically to silence critics, as in my cases covering up for the conduct of law enforcement, and in Seth’s case covering up the crimes of city council members.

“The action was motivated by a series of e-mails he sent to officials, as well as the press, making financially related allegations against yet another council member, KC Becker.”

As myself, Mr. Jentsch and now Mr. Brigham continually state, we know these orders are being taken out in order to silence us and persecute us based on our political opinion.

“It's just that they've wanted to ban me from city council, because I'm a loudmouth and I talk too much. I might be obstinate, I might be insulting, and I have very little respect for these public officials. But as I've stated over and over, I'm not a threat to anyone, I've never been a threat to anyone, and I've never threatened anyone, either."

The government’s actions in taking out protections orders against me, all in the officer’s official capacity, clearly show that I cannot avail myself of the protection of the government. The government of the State of Colorado preventing me from exercising my human right to take part in my government, generally, and specifically exercising it regarding a bill that directly threatened my human rights, is one of the reasons I am unwilling to avail myself of the protection of the governments of United States of America.

My Political Beliefs Expressed at the Boulder Public Library and State Perscution Thereof

On July 29, 2011 I showed up early to a public assembly in the Boulder Public Library. This assembly discussed a proposed constitutional amendment which would regulate marijuana for the more efficient use of law enforcement resources. I arrived well before the meeting which at that point was only attended by the proponent, myself and one other gentleman.

Immediately upon entering the room one of the proponents Emmitt Reistroffer, the state wide petition coordinator, left to get security because he knew my political opinion differed from the proposed amendment.

The next person to arrive to the room before the meeting started was Kathleen Chippi who began recording the interaction. The recording picks up shortly after Emmitt returns with security.

Immediately you can hear proponent Emmitt Reistroffer say, “we started this for our supporters and you are not part of it.”

To which I replied, “you sent an email saying I could come.”

The private law enforcement officer Lorin Phillips say,  “They want their supporters here and you’re not a part of it.”

I then say, “it’s a session on the petition of an amendment to the constitution of Colorado, I am not doing anything disruptive I am having a conversation with this gentleman.”

Again the only man with a gun in the library, Lorin Phillips says, “from what I understand it’s a closed session.”

Kathleen Chippi being misled as much as I was said, “Wo, wo, wo, wait, wait closed session? I came as a general public.”

I then said, “this is a public library this is a public session.”

At the 31 second mark you can hear Emmit Reistroffer, head of the state wide petition and voter fraud, say, “we invited folks to come who wanted to support our initiative, we did not invite folks who came to destroy it.”

To which I said, “I want to ask questions about it.”

Emmitt then went on to say, “because we have had some past situations with that individual; he’s public on record being against this challenging it in court, so I know he has no interest in listening to about what we have to talk about today which is making this thing pass not how to make it lose, so and that’s bottom-line."

Around the 1min 3 mark you can again hear minor mercenary Lorin Phillips again say, “It’s a closed session.”

After company man Lorin Phillips left, the people in the room resumed our previous political discourse.

At the 6min 50second mark again I am told because of my political opinion I cannot take part in this public political discussion.

Reistroffer:¨I didn't want to kick anybody out tonight, yourself included.¨

Me: ¨Oh, the police are gonna kick me out.¨

Reistroffer: ¨...but I have to.¨
[Garbled conversation]

Me: ¨I'm not going to leave.¨

Reistroffer: ¨You know and I know you that you are 100 percent opposed to this.¨

Kathleen Chippi: ¨You guys know each other?¨

Reistroffer: ¨I know of from him…I’ve seen him protesting.¨

Me: ¨I’m not protesting I am engaging in discourse with this gentleman.¨

Chippi: ¨Protesting prohibition you mean?¨

Reistroffer: I believe you are against prohibition correct?¨¨

Me: "Of Course." I said, as I am 100% against the War on Drugs.

Reistroffer: “We want you guys on our side you know.”

The 14 min mark marks the point where, in this instance, the state persecutes based on my political opinion. Up to the 14min 35sec mark police get me to step out in the hall.

At the 14min 35 sec mark you can clearly hear me question the officer.

Me: ¨For what reason am I being pulled out of the public library?¨

Officer: ¨It’s a private meeting. The Library staff has instructed us this is a private closed door meeting.¨

Me: ¨This is a public library…can I have your card sir.¨

Officer: ¨Absolutely when we’re done talking, you bet.¨

Me: ¨Because when we are done I am going right back in.¨

Officer: ¨No you’re not.¨

Me: ¨Yes I am.

Officer: ¨Can we tress pass him from here? Ok…I’m going to ask you to leave the library premises right now I’m going to give you one warning if you don’t leave I am going to arrest you walk you out front and charge you with trespassing.¨

I asked Kathleen Chippi to take my backpack. Then told the officer,

“No.”

At the 15 min 18 second mark, as the hand cuffs click on, you can hear Emmitt Ristroffer welcome everyone to the meeting saying,"We are making history.” In a tone that would make a guano rummager weep.

You sure are Emmitt, you sure are.

Finally around the 17min 22sec mark, rent-a-security Lorin Philips says I am being ejected from the library for misbehavior and creating a disturbance.

At the 20 min mark you can see the public political discussion taking place in the Boulder Public Library continued unabated

I was in a public library in a public room taking part in a political discussion and because my political opinion I was arrested and jailed by the state. As this was clearly a violation of my human rights law enforcement lied attempted to say I was trespassing as the meeting was private.

"Jennifer Bray, Boulder Library spokeswoman, confirmed that the meeting room has to remain open to the public, even when reserved for meetings."

Then private law enforcement finally said I was being evicted for misbehavior and creating a disturbance, which I was never charged with. I was charged with Trespassing. Emmitt Reistoffer even admits he had me kicked out because my opinion was counter to the initiative and not for any other reason,

"Donahue told him that he was there to learn more and that might consider joining the campaign. But he believes this claim was a ploy to sideline the intent of the meeting, especially given Donahue's frequent public pronouncements against the Regulate Marijuana Like Alcohol Act."

Then on my way to the jail as I was in handcuffs I called the state law enforcement officer a, “no talent ass clown. Which earned me a reprimand, I retorted with “then you a fucking no talent ass clown.” Which I was subsequently charged with use of fighting words.

Before the meeting even started I was arrested charged with two crimes and jailed. I took this charge to trial. I even submitted documents calling for the charges to be dropped on constitutional (human) rights grounds. The stated denied this petition as well as threatened me to plead guilty to different charges I was never accused of in order to save the money of having to try me. As I entered the court house on the day of my trial I was handcuffed in the front lobby by law enforcement and made to sit and wait until my lawyers arrived, thus prejudicing possible members of my jury.

During the trial both private security and Boulder law enforcement stated that because the meeting was closed, which it was not, I was causing a disturbance just by being there and expressing my political opinion I was trespassing. Emmitt during the trial also admitted again during the trial that only reason he got security what because he knows I am counter to the initiative.

Kathleen Chippi testified on my behalf verifying the authenticity of the tape. She stated clearly I was never causing a disturbance and I was arrested because of my political opinion was known, as Emmitt Reistoffer stated many times in the recording. Kathleen went on to explain that she too was against the proposed initiative but was not kicked out because these Emmitt Ristroffer and these particular state/private officers were unaware of her political opinion.

I was convicted of both trespassing and use of fighting words, thus implicating the entire Boulder County criminal justice system in the denial of my human rights to peacefully assemble and express my political opinion. All court documents can and should be furnished by the City and County of Boulder or my lawyer Adam Platt. As such and fearing for my life and liberty I am unwilling and unable to avail my self of the protection of the Governments of the United States of America.

False Arrest in Governors Office

Undeterred by the state repression, I continued to take part in the peaceful assembly and I continued to voice my political opinion. The following arrest based on my political opinion took place in the governor’s office in the state capitol. After the continued brutalization of our protest, I organized a group to have a political discussion in and around the front lobby of the governor’s office. We politely discussed with one another how we felt our human rights were being violated as well as the inner workings of state government. Immediately upon entering our capitol everyone in the group was searched and harassed by law enforcement. Shortly after we entered the public office of the governor I was approached by state patrol officers and informed me that they had a warrant for my arrest, due to my failure to appear at a court date on a traffic violation. I informed the officers this warrant was not for me and the warrant issued for me was rescinded by order of the courts and even produced papers issued by the court rescinding the warrant. I carried around the papers rescinding the warrant because I knew law enforcement would simply arrest and jail me, as law enforcement just enforces the law as they are too stupid to understand the laws. After being jailed I would then have to prove to the court, who interprets the laws however that particular official of the state sees fit, that in fact the warrant was rescinded. To save myself the trouble of being arrested and having my human rights violated, I carried around the orders rescinding the warrant. One of the officers then took the papers and contacted their superior officer, when they came back they informed me the court did withdraw this warrant but issued one for my arrest based on a traffic ticket, a charge which I was never charged with. I was then arrested. Everyone who was watching, and still peacefully and legally sitting in their state capitol, was forced out by law enforcement. Then I was kidnapped and jailed for 12 hours and released with no explanation and no charges pressed. All additional documents can and should be provided by the city and county of Denver and state of Colorado.

The following day, officers of the state inform me I am banned from entering the capitol specifically because of my political speech and that this ban was in force not by any act of law but by the order of a superior officer’s opinion of my political speech.

“Donahue, who was accused of verbally assaulting a state patrol officer this morning, is currently prohibited from entering, though officials aren't sure how long this ban will last, officer C.J. Valdez says. Donahue says he'll return tomorrow to see if the ban is still in place, though a final attempt today ended with him being promptly escorted from the building and the door shut behind him.”

“When asked how state troopers are enforcing Donahue's ban from the building, Valdez said that a supervisor made the decision and that there's no need to pass around Donahue's image. “We’re all aware who he is," Valdez says. "We've had experience with him before.¨

State Persucution Based on Denial of Legal Open Records Requests

During the summer months of 2011 the state persecuted me for legally demanding public documents which the state subsequently destroyed in order to cover up the state’s criminal actions. The Medical Marijuana Criminal Enforcement Division (MMED) is an illegal law enforcement creation acting as a paramilitary to control our human right to access cannabis in general and our constitutional right to access cannabis for debilitating medical conditions. Colorado Open Records Act (CORA) allows for inspection of public documents. I made this legal request. The Medical Marijuana Enforcement Division broke the law by not responding to me in 7 days legally required.

In fact they never responded and I had to constantly demand my rights to the documents. I was accompanied all attempts to retrieve these public documents by motalero and community organizer Miguel Lopez. The day I was to receive the request documents, well after the legal time frame, although the state claimed they had them, the documents were not ready. I then attempted to get the DPD to enforce the criminal previsions of the CORA act. The patrol officer began filling out a report when a commanding officer directed him to leave as they were not going to enforce this law. I guess strict enforcement of the law is only reserved for people speaking out against government fraud. As DPD did not enforce the CORA law I attempted to file a criminal charge against the MMED in the Denver district attorney’s office. The district attorney Mitchell R. Morrissey then ignored my complaint and forwarded my accusation to the MMED who is the suspect in this complaint. In order to cover their tracks MMED’s public information officer Julie Postlethwait finally responded she said she had no way of contacting me. . Even though I gave the MMED my contact information and the paper it was on was time and date stamped received by the MMED. When documents were finally produced, months after the legal time frame permitted and only because of my constant attempts to have criminal law enforced, Julie Postlethwait said most emails were destroyed by Matt Cook the head of the MMED after my request came in and before he left office. Recently it was uncovered that the MMED extorted and illegally spent public funds, and Matt Cook was responsible for the fraudulently stealing of 2.5 million dollars during the same time frame as my open records request. What I finally received after months of attempting to legally recover the documents were not what I legally requested and were simply press releases from the governor’s office, which anybody could have printed off of the internet. The state persecuted me specifically to cover up its crimes of at the least destroying public documents, stealing money from public funds and depending on what was discussed in those documents, violating our human rights. As violation of the Colorado Open Records Act is a misdemeanor with a greater punishment attached to it than the crimes I was subsequently charged with. The destruction of public documents is a disgusting and terrifying occurrence that happens in Colorado, and around the nation, again and again and again.

The MMED attempted to charge me $65.50 for the documents they attempted to swindle me with. I walked away with the documents without being extorted by the MMED. I was subsequently charged with disturbing the peace and petty theft which have less sever criminal punishments then the criminal aspects of the CORA act. There was also a restraining order taken out by Julie Postlethwait. This protection order was taken out against me by a member of the government of Colorado in their official capacity based on my peaceful political activity. I was never accused of a crime towards Julie Postlethwait This protection order was taken out in order to prevent me from accessing public documents in the MMED as Julie Postlethwait is the person I have to contact in order to review documents. This protection order also silenced my political opinion and right to assemble by prohibiting access around or in government buildings.  This also allowed the MMED to cover up their crimes of destroying public documents. Julie Postlethwait ’s restraining order is the first of 6 protection orders taken out against me based on my political opinion. All additional documentation not referenced above can and should be provided by the state of Colorado and the city and county of Denver.

False Imprisionment Based on Cannabis Laws

On March 30th 2012 Aleene Ortez-White a member of the state acting as judge in case #11GS910853 sentenced me to jail for a failure to appear in her court room on a charge of possession of less than 1 oz of marijuana. The problem with this is that I was engaged in a legal act of possession marijuana. The voters of Colorado approved an amendment to allow for the possession of cannabis in order to treat debilitating medical conditions.

(4)(a) A patient may engage in the medical use of marijuana, with no more marijuana than is medically necessary to address a debilitating medical condition. A patent's medical use of marijuana, within the following limits, is lawful:
(I) No more than two ounces of a usable form of marijuana; and
(II) No more than six marijuana plants, with three or fewer being mature, flowering plants that are producing a usable form of marijuana.

As the State, Aleene Ortiz-White, and the prosecution all had my doctor’s recommendation and I even read the constitution in the court room, it was clear that I was abiding by the law. Yet I was still arrested. I spent 10 days in jail until when I was in front of the court again I was informed that if I did not plead guilty to the petty theft charges that Julie Postlethwait and the MMED filed against me I will be thrown back in jail for legally possessing less than 1 oz of cannabis. All court documentation of these events can be provided by the city and county of Denver.

As this section clearly shows I have been routinely persecuted by the state of Colorado for simply exercising my political opinion and human rights. Because of the constant loss of liberty I have already faced at the hands of the governments of the United States of America I am unwilling and unable to avail myself of the protection of the governments of the Unites States of America.

State Use of the Criminal Justice System to Persecute Based on My Political Beliefs Accusations of Inciting a Riot

On November 13th 2011, illegally disperse a peaceful assembly by intimidating and forcefully closed Civic Center Park. The Denver police department along with Colorado state patrol placed 40 plus officers in both Civic Center Park and Lincoln Park. The Denver Police Department began by forcefully removing a table which had displayed political pamphlets.

During the assembly law enforcement as it had for the past month, parked patrol vehicles in the middle of Civic Center Park where people would typically gather and express their political opinion, in order to intimidate us from peacefully assembling or exercising our political opinion. As I was walking through the park a law enforcement vehicle, which was in the park for the singular purpose of harassing and intimidating the people assembled, attempted to force me off the sidewalk dividing the park. I stood my ground on the sidewalk and soon a group gathered. Other law enforcement officers quickly came to force me off the sidewalk. I did not move and as you can clearly hear at 6 min 26 second of the video me asking, “What law am I breaking standing in the park?” I was then shoved out of the way by an officer. I hopped up and continued my walk in the park, at which point I was arrested by law enforcement. The state was only in Civic Center Park to terrorize people and prevent them from exercising their human rights and I was not going to be intimidated. I was immediately handcuffed and moved to a patrol car, during this time you can hear me yell “what law am I breaking walking in the park?”

The reason for my arrest would soon be fabricated entirely by law enforcement. I was jailed a short distance away at the district 6 Substation, where I was further assaulted when I was removed from the patrol car and the officer slammed me, still handcuffed, in to the buildings outer wall. In the jail, officers repeatedly threatened me. Eventually, a law enforcement officer entered my cell, charged me with inciting a riot and attempted to coerce and interrogate me.

The allegation of inciting a riot comes from the end of the video where Sara Garcia is violently assaulted by law enforcement. Assault of the young and females is a common law enforcement tactic used in order to incite violence which allows law enforcement to charge graver criminal code violations against people. The state claims my act of peaceful assembly and peaceful expression of my political opinion caused a 3 person riot. As Sara Garcia, Brandon Sexton and myself were the only three arrested and respectively charged with the crimes of participating in, participating in, and inciting a riot, respectively.

This is another blatant attempt by the state to criminalize the peaceful assembly in Civic Center Park. I was not arrested in the park for any crime. I was simply taking part in a peaceful political assembly and discussing my political opinion and legally walking through the park. At no point did I break any law. Law enforcement then violated people’s human rights and illegally disperse people peaceful assembled in Civic Center Park. Then law enforcement violently attacked Sara Garcia and Brandon Sexton to cover up this violent repression of human rights and needing something to justify my kidnapping the state charged me with inciting a riot. Charging me with a crime regarding my speech not only help mask the human rights violations the state committed, but allowes the state to use this ambiguous law to criminalize all of my past and future speech. This charge can also be used as a justification for repression, by the state, in future cases when I decide to express my political opinion. As I again was assaulted, arrested, jailed for simply exercising my human rights. As such and fearing for my life and liberty I am unwilling and unable to avail myself of the protection of the governments of the United States of America.

Fabricated Unlawful Sexual Contact Charge

Shortly before this happened, a professional private/state sponsored propagandist Robert McClure, came over to the new Thunderdome which was again serving the peaceful political assembly delicious food.

As an embedded private/state sponsored propagandists Mr. McClure traveled to Iraq in order to report only the US government’s official story, which helped to continue the crime against humanity happening in Iraq. The state-private link is further made when a quote from Mr. McClure’s company biography shows he went to Iraq with another employee of the same privately held news organization who was also a surgeon with the U.S. Army.

"In 2004, he traveled to Iraq as he accompanied CBS4′s Dr. Dave Hnida, a battalion surgeon with the U.S. Army, on his first tour of duty there. His experiences and observations in Iraq have given Rob a deep appreciation and respect for those who serve our country in the armed forces."

Propagandists McClure's bias showed he was clearly there to report the state’s official story when he started video interviewing Justin Gwin who was in the Thunderdome.

This conversation began when with a repeating of the state’s message, which was “the Thunderdome and the assembly were illegal and that we should get a permit in order to do this.”

As Justin was standing between propagandists McClure and I, I turned towards the huge crowed assembled and began handing out sandwiches and inquiring of the people we were feeding if they permitted me to feed them? As they all responded that yes they permit me to feed them, I turned back towards Crunchy and then stated, “these people are our permit.”

As my comments did not fit with the state sponsored script the reply was, “shut up I am trying to do an interview.”

I retorted with, “you got editing right? Well then fuck you, you can edit it.”

Propagandist McClure then yelled, “why the fuck don’t you listen to law enforcement and quit causing trouble.”

I responded to the with a little song and dance saying, “Motherfucker this is the Thunderdome, we serve people free food,” I then handed a sandwich to a hungry person, and nut-taps, and made a backhand motion towards the propagandist McClure. I never made contact as Justin Gwin and a table was between me and propagandist McClure. Later that evening after the state illegally closed Civic Center Park, I was arrested for a fabricated charge of unlawful sexual contact on propagandist Robert McClure. These charges were pressed to further discredit and propagandize against people taking part in a peaceful political assembly and oppress me based on my political opinion. The state maltreats people convicted of sex crimes to a much greater extent than normal crimes. I was determined to fight these fabricated charges.

As the months passed the state repeatedly threatened and attempted to coerce me to get me to plead guilty to crime I was not charged with in order to save them the cost of trying me in front of a court of law. Assistant District Attorney, the corpulent load Matt Winig, repeatedly threatened me with increased jail time if I did not submit to the state will and plead guilty to all other charges I was charged with as well as charges I was never charged with. As I did not submit to the states intimidation, the state made good on their threats and added an additional charge of assault in the third degree in this case and other various charges in the other cases the state illegally brought against me. The trial finally took place almost a year after the original charges. This was done to allow the government propaganda campaign against the peaceful political assembly to frame the issues in favor of the government.

During the trial before I even was allowed to present my defense, the tool of the state Andre Rudolf acting as judge on the behest of law enforcement, questioned and threatened my witness, Justin Gwin, with arrest. The questioning of state video campaigner Robert McClure revealed that even though there was 7 plus hours of video tape that day, the camera was turned off when the fabricated sexual offence was committed.

Propaganda publicist Robert McClure also stated on the record that in the video he presented and was being used by the state, to persucute me, was edited to show the “important” parts. Three different Law enforcement officers, the same three whom requested the arrest of my witness, testified that although I was accused of a sexual crime, and the state increases the subjugation of people convicted of sexual crimes, they did not investigate government journalists Robert McClure’s accusations and this alleged crime. Law enforcement failed to investigate a crime even when provided with a video showing many witnesses and even a named witness, Justin Gwin.

When Justin Gwin took the stand, after being threatened with arrest, he confirmed law enforcement never interviewed him. Justin also testified that as seen in the video I was nowhere near state Robert McClure and law enforcement had constantly been targeting the Thunderdome.

Through the entire trial, from the edited evidence, judicial and law enforcement threats aimed at me and my my witness, lack of any investigation by the law enforcement body tasked with investigating these types of crimes, to the threats to prevent me from going to trial, it was clear the state is fabricating charges in order to persecute me based on me taking part in a peaceful assembly and expressing my political opinion. All legal document and 7 plus hours of the footage propagandists McClure has regarding his allegations can and should be provided by the city and county of Denver and CBS4 in Denver, Colorado.

As the US government and it corporate overloads used the criminal justice system actively persecute me based on my human rights to peacefully assemble and legally exercised my political opinion I am unwilling and unable to avail myself of the protection of the governments of the United States of America.
